Terms of Service

To access certain features of our Services, you must create an account. When creating your account, you agree to:

• Maintain the security of your password and accept all risks of unauthorized access
• Notify us immediately if you discover or suspect any security breaches related to our Services
• Take responsibility for all activities that occur under your account

We reserve the right to suspend or terminate your account if any information provided during registration or thereafter proves to be inaccurate, false, or misleading.

All products listed on our website are subject to availability. We reserve the right to limit the quantity of products purchased per person, per household, or per order.

We strive to provide accurate product information, including descriptions, prices, and images. However, we do not warrant that product descriptions, prices, or other content is accurate, complete, reliable, current, or error-free.

In the event of a pricing error, we reserve the right to cancel any orders placed for products listed at the incorrect price.

By placing an order through our Services, you offer to purchase the products subject to these Terms. All orders are subject to acceptance by us, and we will confirm such acceptance by sending you an order confirmation.

We accept various payment methods, including:

• M-Pesa
• Credit/Debit Cards
• Bank Transfers

You represent and warrant that you have the legal right to use any payment method you use to complete a transaction.

We aim to process and ship orders within 1-7 business days. Delivery times may vary depending on your location within Kenya and product availability.

Risk of loss and title for products pass to you upon our delivery to the carrier. You are responsible for filing any claims with carriers for damaged or lost shipments.

Some areas in Kenya may have limited delivery options. We reserve the right to refuse service to any location.

We want you to be completely satisfied with your purchase. If you are not satisfied, you may return eligible products within 14 days of receipt for a refund or exchange.

To be eligible for a return:

• The product must be unused and in its original packaging
• The product must be in the same condition as when you received it
• You must provide proof of purchase

Certain products, such as perishable goods or personalized items, may not be eligible for return. Please see our Returns Policy for complete details.

Our Services may allow you to post reviews, comments, and other content ("User Content"). You retain ownership of any intellectual property rights that you hold in that User Content.

By posting User Content, you grant SokoFarm a non-exclusive, royalty-free, perpetual, transferable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content throughout the world in any media.

You agree not to post User Content that is illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties.

You may use our Services only for lawful purposes and in accordance with these Terms. You agree not to use our Services:

• In any way that violates any applicable national or international law or regulation
• To engage in any fraudulent or deceptive activities
• To impersonate or attempt to impersonate SokoFarm, a SokoFarm employee, another user, or any other person or entity
• To interfere with or disrupt the integrity or performance of our Services
• To attempt to gain unauthorized access to any portion of our Services or any systems or networks connected to our Services

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by SokoFarm, its licensors, or other providers of such material and are protected by Kenyan and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as incidental to normal use of the Services or with our prior written consent.

YOUR USE OF THE SERVICES AND PRODUCTS IS AT YOUR SOLE RISK. THE SERVICES AND PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SOKOFARM DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

SokoFarm does not warrant that the Services will be uninterrupted, secure, or error-free; that defects will be corrected; or that the Services or the server that makes it available are free of viruses or other harmful components.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL SOKOFARM, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, ANY WEBSITES LINKED TO THEM, ANY CONTENT ON THE SERVICES OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of Kenya.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the courts of Kenya, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country.

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Services thereafter.

Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.
